Caraco wins summary judgment on generic Ultracet in US

Detroit-based Caraco Pharmaceutical Laboratories, Ltd has confirmed that the United States District Court of New Jersey has granted Caraco's motion for summary judgment that the claims of US Patent No. 39,221 that Ortho-McNeil Pharmaceutical, Inc. asserted against Caraco are invalid. Caraco's Tramadol with Acetaminophen product is a generic version of Ortho-McNeil's Ultracet. The company commenced shipment of Tramadol with Acetaminophen following the FDA's approval to manufacture, market and distribute the generic product on December 19, 2005, and it has remained on the market since that time. The company develops, manufactures, markets and distributes generic and private-label pharmaceuticals to the nation's largest wholesalers, distributors, drugstore chains and managed care providers.
