Bihar initiated 118 prosecutions under D&C Act in 2004-05

If the number of prosecution charges launched against drug makers is any indication, Bihar has been the most active state with regard to the initiation of enquiry against alleged spurious / substandard drug manufacturers during the year 2004-05. The figures provided by the Health Ministry shows a total of 118 prosecution charges launched by Bihar drugs control department during the period. Andhra Pradesh comes next, with 73 cases charged during the same period.

Interestingly, figures show that among the states, at least 14 had found no case of violation of Drugs and Cosmetics Act during 2004-05. Even in the states where such prosecution measures were initiated, it was just single digit numbers - Madhya Pradesh, Tamil Nadu, Maharashtra, Gujarat and Haryana being exceptions.

While Tamil Nadu had taken 33 cases for violation of D & C Act, it was 34 by Madhya Pradesh. The number of cases initiated in Gujarat and Haryana were 14 each. There were 11 cases initiated in Maharashtra. The list of detection of spurious / adulterated drugs also poses interesting comparison as there were no proven cases of spurious drug manufacturing / sale from the state. Tamil Nadu had more number of spurious drug detections (47) to be followed by Madhya Pradesh (23), West Bengal (20) and Punjab (13).

The instances of detection of spurious / adulterated drugs from other states were Andhra Pradesh (5), Gujarat (4), Haryana (1), Himachal Pradesh (1), Karnataka (8), Kerala (1), Maharashtra (2), Orissa (2), Rajasthan (7) Uttar Pradesh (7) and Delhi (3).
