Courts issue more retraining orders to AIOCD for issuing threats to cos for supplying drugs to AICDF members

Even as the trade war between the two associations, AIOCD and AICDF, is getting harder, restraining orders are being issued by various courts in the country to the biggest trade body, AIOCD, for its alleged threats to manufacturing companies for supplying drugs to the members of the opposite group.

Following the recent restraint order by the Punjab and Haryana High Courts to AIOCD branches operating in Punjab and Amritsar, in last week, the High Court of Orissa, restraining AIOCD, has directed two manufacturing units to resume supplies to a member of AICDF hails from Kendrapara in Orissa.

Prasanta Mohapatra, general secretary of the Orissa branch of AICDF said Torrent Pharmaceuticals from Ahmadabad and Jyoti Pharmaceuticals from Cuttack had stopped supplies of drugs to Suraj Traders centered at Kendrapara at the behest of J S Shinde, president of AIOCD. He further said Shinde has blocked supplies of 26 companies to the traders of Orissa and Orissa Chemists Federation has filed six cases in the High Court there, against Shinde.

Last month, the Punjab and Haryana High Court had issued restraint orders to the state branches of AIOCD, Punjab Chemists Association (PCA) and Amritsar Chemists Association (ACA), for obstructing supplies of drugs from 39 manufacturing companies to the members of the Punjab Chemists Federation.

A few months ago, the Competition Commission of India (CCI) had issued a restraint order to the AIOCD from issuing any direction or threat to the Mumbai based multinational company Janssen Cilag Pharmaceuticals to terminate its distributorship with Peeveear Medicals of Kerala.

In May this year the Commission had wanted the national trade body led by Jagannath S Shinde not to issue any direction or threat to USV Ltd for terminating its C&F agency with Santuka Associates, in Orissa.
